General Terms and Conditions
§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all purchase inquiries and contracts initiated between Steffen Klein (Sole Proprietorship) – hereinafter referred to as the "Seller" – and the customer via the communication channels of the website mallorca-moebel.de as well as the associated domains (including muebles-baleares.es, balear-cargo.de, balear-cargo.es).
§ 2 Conclusion of Contract (Individual Inquiry)
(1) The products presented on the website do not constitute a binding offer, but rather an invitation to the customer to submit a non-binding inquiry.
(2) Following your inquiry (via WhatsApp, email, or phone), we will check the availability with the dealer as well as the capacities for the delivery of our goods to Mallorca within the framework of our own-account transport.
(3) A binding contract is only concluded when we create an individual offer for you and you expressly accept it (e.g., by confirming the message or paying the invoice).
§ 3 Prices and Provision
(1) The prices stated on the product pages include the statutory Spanish value-added tax (IVA).
(2) The delivery of the sold goods is carried out by the Seller within the scope of its own-account transport. The costs for the provision and the logistical effort of the delivery are calculated as a service flat fee and shown in the individual overall offer.
§ 4 Delivery Conditions and Reservation of Self-Delivery
(1) Delivery takes place on the route Germany/Netherlands – Mallorca directly to your address or, if necessary, to our intermediate warehouse in 07420 Sa Pobla/Mallorca.
(2) If a product is not deliverable due to non-availability from the upstream supplier, we retain a right of withdrawal. In this case, we will inform you immediately.
§ 5 Payment Conditions
Payment is made either by payment in advance or bank transfer.
§ 6 Retention of Title
The goods remain the property of Steffen Klein (Sole Proprietorship) until full payment of the total invoice amount has been made.
§ 7 Liability and Transport Damage
(1) If goods are delivered with obvious transport damage, please complain about such defects to us immediately and document them photographically.
(2) Transportation is carried out as own-account transport in accordance with § 1 Paragraph 2 of the German Road Haulage Act (GüKG). Liability for the goods during transportation by the Seller is governed by the general provisions of sales law.
§ 8 Characteristics of the Goods and Warranty
(1) Special nature of the product range: The offered goods are high-quality pieces of furniture, unique items, or limited productions. They are explicitly not industrially manufactured mass products.
(2) Decisiveness of the presentation: The characteristics of the goods are primarily determined by the object photos on the website. The customer is advised that slight deviations in color and structure may occur in the digital display.
(3) Duty of care of the customer: Due to the individuality of the pieces, the customer is requested to clarify any detailed questions or request additional images before concluding the contract, provided specific features are essential for the purchasing decision.
(4) Material-typical properties: The customer is aware that in the case of the materials used (in particular solid wood and metal in industrial design), the following features do not constitute a material defect in the legal sense: Solid wood: Natural knot holes, growth cracks, as well as structural and color differences that can arise from the natural "working" of the wood. Industrial design: Characteristic features of manual processing, such as visible weld joints, intentional grinding marks, or production-related irregularities in the metal surface.
§ 9 Notice of Defects and Supplementary Performance (Mallorca Regulation)
(1) Duty to give notice: The customer is obliged to check the goods for obvious defects upon delivery and to report them in writing without delay, attaching meaningful photographic documentation.
(2) Priority of supplementary performance: In the event of a justified defect, the Seller has the right to supplementary performance. Due to the special logistical situation in Mallorca, the Seller reserves the right to have the supplementary performance carried out by a qualified specialist company locally on the island, provided this is reasonable for the customer and fully restores the value of the goods.
(3) Exclusion of reduction for minor deviations: A reduction of the purchase price or withdrawal from the contract is excluded if there is only an insignificant deviation from the target condition which does not significantly impair the function or the overall aesthetic impression of the unique piece.
§ 10 Final Provisions
German law applies. To the extent legally permissible, the place of jurisdiction is Bad Homburg v. d. Höhe.
